Terms of Service

Transparency, safety and user rights

Preamble

  • HikeBike provides route planning, navigation and route tracking services.
  • These Terms constitute a legally binding agreement between you and HikeBike.
  • Using the app means you accept these Terms.
  • Personal data processing is described in the Privacy Policy.
  • Sensor data (heart rate, cadence, power) requires separate explicit consent and can be disabled at any time.

Access and registration

  • Creating an account is required to use core features.
  • You must provide accurate and up-to-date information.
  • Your account is personal; you are responsible for how it is used.
  • Deleting an account removes data from active systems.
  • Some data may remain temporarily in backups and technical logs, subject to legal obligations and technical purge delays.

Age requirement

  • Our services are intended for users who have reached the minimum legal age to consent to personal data processing and enter a binding contract (for example, 15 in France).
  • If you are below this minimum age, you may only use the services with permission from your parent or legal guardian.
  • By using the service, you represent that you meet these age requirements or have the required authorization.
  • We may suspend or delete accounts that do not meet applicable age requirements.

Use of the service

  • You may create, save, share and sync routes.
  • Fraudulent, abusive or illegal use is prohibited and may lead to suspension or deletion.
  • You must comply with local laws and rules (road code, trail access, private areas).
  • You must not use the service in a dangerous way (for example emergency navigation without real-world checks).

User content and moderation

  • You are responsible for the content you publish (routes, photos, comments).
  • Illegal, violent, pornographic, hateful, defamatory or rights-infringing content is prohibited.
  • HikeBike may remove non-compliant content and suspend related accounts.
  • A reporting system may be used for moderation and community safety.
  • You keep your rights to your content, but grant HikeBike a non-exclusive, worldwide, royalty-free license only to operate and promote the service.

Safety and physical responsibility

  • Routes, weather conditions and map information are provided for guidance only.
  • You must verify real-world conditions (weather, safety, access, hazards, regulations).
  • You use the service at your own responsibility.
  • HikeBike is not liable for damage resulting from misuse of the service or failure to follow safety rules and applicable regulations.
  • The service is provided as is, without warranty of uninterrupted or error-free operation.
  • The service is not a safety or rescue device.

Intellectual property

  • App content (code, maps, images, texts) is protected by copyright.
  • Copying or redistribution without authorization is prohibited.
  • Third-party data (OpenStreetMap, Mapbox, etc.) is subject to its own licenses.

Payments and subscriptions

  • Website payments are handled by Stripe. On mobile, purchases are handled by the App Store or Google Play.
  • HikeBike does not store bank card details.
  • Subscriptions (monthly or annual) renew automatically until canceled.
  • You may cancel at any time from your billing area (Stripe) or through the App Store / Google Play.
  • Cancellation takes effect at the end of the current billing period.
  • For purchases made through Google Play, refund terms are governed by Google Play rules.
  • For purchases made through the App Store, refund terms are governed by App Store rules.
  • The offline pack is a one-time purchase, activated immediately and valid for life.
  • Trial periods may be offered. Unless stated otherwise, subscriptions become paid after the trial if you do not cancel before it ends.

Governing law and jurisdiction

  • These Terms are governed by French law.
  • Any dispute relating to these Terms is subject to the jurisdiction of French courts, unless mandatory consumer protection laws provide otherwise.

Consumer mediation (France)

  • Under French Consumer Code articles L.612-1 and following, if a dispute remains unresolved after a written complaint, you may use a consumer mediator free of charge.

Personal data and security

  • Collected data is limited to what is needed to operate the service.
  • No personal data is sold or shared for commercial purposes.
  • You can access, edit, export or delete your data at any time.
  • Community photos are deleted when the account is deleted.
  • All communications are secured through HTTPS/TLS.
  • The Privacy Policy details legal bases, retention periods and applicable rights.

Availability and maintenance

  • We may temporarily suspend the service for maintenance, security or updates.
  • We use reasonable efforts to limit downtime and inform users when possible.

Changes to these terms

  • These terms may change for legal, technical or functional reasons.
  • For major changes, explicit acceptance may be requested.
  • Updates are communicated in the app or by email.
